If that's the case, how come USCIS is not sensitive to the fact that EB-5 investors truly help the US economy during recession. We hear more and more Chinese EB-5 investors and Chinese Emigration Consultants are unhappy that many Regional Centers appear to be just trying to make quick money off Chinese EB-5 investors without giving enough control and protection to their needs.
We are sympathetic to the concerns of Chinese EB-5 investors, but we believe that a primary reason for the risk in the EB-5 cases is due to the inconsistency in USCIS policies and adjudications. For example, currently not even so-called EB-5 experts know what is the USCIS position on the TEA designation issue, because USCIS went back and forth several times on TEA issue; and our understanding is that many state designated agencies in charge of issuing TEA certification letters are also confused on this issue. And to think the EB-5 Program has been in effect for close to 20 years, and no clear and practical USCIS policy exists on the TEA issue! The first thing SelectUSA should do is to figure out how EB-5 Program should be changed to better reflect the real commercial needs of U.S. businesses.
It's a time to either make serious and fast improvements to the EB-5 Program or shut it down. "Put up or shut up" time.
