Energy, real estate and banking deals dominate our - Financial Post

The slow summer months can make the third quarter a tough period, but Canadian legal firms saw quite a spike of activity in September.

Deal flow was down year over year, but deal values rose significantly. Some 37 firms represented issuers on 115 debt and equity deals that raised a total of $24-billion in public markets in the third quarter, compared with the 50 firms that worked on 123 deals worth a combined $17.4-billion in the same period last year.

The question for firms is whether the third-quarter momentum will continue for the balance of the year. We?re already one month into the final quarter, and it looks like the September surge has slowed.

?It does seem that the market is softer,? says Karrin Powys-Lybbe, co-head of the corporate and capital markets practice at Torys LLP. The firm placed first in our ranking of underwriter advisors on equity deals. ?It?s a little early to tell. We may get a rebound before the year end.?

Jonathan Grant, a partner in the Toronto office of McCarthy T?trault LLP, says the third quarter?s activity might have been impacted by some unique market conditions. ?We?re generally finding that issuers have taken advantage of the debt markets where they can and have topped up their funding. So the expectation is that that segment of the market may not be as robust for that reason over the next little while.?

Back to the third-quarter results. Energy and real estate were particularly active, but it was the banks that came to the market with some blockbuster offerings.

Bank of Nova Scotia raised $1.7-billion in common shares ? the biggest equity deal of the quarter ? and another $1.5-billion in debentures to finance its $3.2-billion purchase of ING Direct. Osler, Hoskin & Harcourt LLP advised the issuer and Torys advised the underwriter. Norton Rose Canada LLP advised issuer Royal Bank of Canada on the largest single deal of the quarter, a $2.4-billion cross-border bond offering.

Norton Rose Canada?s work on the RBC deal and several notable energy matters puts the firm in the top spot in our marquis table, Canadian legal counsel to the issuers on combined debt and equity offerings. Norton Rose also topped our table for legal advisors to issuers on debt offerings.

Bob Engbloom, deputy chairman of Norton Rose Canada, says the firm?s strong performance reflects the recent fusion with Macleod Dixon LLP. ?This is exactly why we came together,? Mr. Engbloom says. ?We wanted to do this merger so we could blend the strength of the two legacy firms across the country.?

Norton Rose Canada worked on five deals for issuers worth a combined $4.84-billion, followed by Osler (eight deals, $4.18-billion), McCarthy T?trault (10 deals, $3.09-billion), Torys (eight deals, $1.96-billion) and McMillan LLP (four deals, $1.8-billion).

Desmond Lee, a partner in the Toronto office of Osler, says while the market is choppy, foreign investors continue to look at Canada as a great place to raise capital. Osler topped our table for advisors to equity issuers.?We?re tailor-made for certain types of businesses, because of our market size, because of our coverage of natural resources and because of the strength of our economy.?

Deal flow is an excellent measure of a law firm?s strength as it reveals a firm?s ability to generate consistent business. As is often the case, Stikeman Elliott LLP led the pack, advising issuers on 11 debt and equity matters, followed by McCarthy (10 deals) and Osler and Torys (eight deals each).

?Achieving consistency in such an inconsistent market is comforting, but we do not take it for granted.?We are not a ?rest-on-our-laurels? type of shop,? says Jeffrey Singer, a partner in the Toronto office of Stikeman.

Blake, Cassels & Graydon LLP topped our table for underwriters on debt and equity deals combined, working on 17 deals worth $5.08-billion, followed by Torys (13 deals, $4.26-billion), Goodmans LLP (seven deals, $2.61-billion), Fraser Milner Casgrain LLP (seven deals, $1.46-billion) and Davies Ward Phillips & Vineberg LLP (five deals, $1.25-billion).

Blakes also appears at the top of our table for advisors to debt underwriters. The firm seeks to balance its work for both issuers and underwriters, but it can be easier to secure underwriting mandates. Canada has a limited number of big securities underwriters, and the nature of their work has them steadily active in capital markets, says David Toswell, a partner in the firm?s Toronto office. ?You really pursue both sides of the equation, but the reality is that underwriter work is more frequent as it?s more readily accessible.?

DEAR BARRY: Your articles often recommend that home inspectors be hired to inspect brand-new homes. If a home has just been inspected and approved by the building department, what's the point of hiring a private home inspector? --John

DEAR JOHN: The answer to your question is worth repeating. Here are the five essential differences between a building department inspection and a professional home inspection:

1. A building inspection is strictly for building code compliance, but it is possible for a home to be poorly built and still comply with code. Home inspections deal with all kinds of substandard conditions, including those that do not involve code, such as poorly fitted doors, poorly mitered trim, missing tile grout, missing shelves in cabinets, sloped floors, loose toilets and faucets, etc.

2. A building inspection usually lasts about 15 to 30 minutes, while a home inspection lasts from 2 1/2 to four hours. This is because many more things are inspected and tested in the course of a home inspection.

3. Building inspectors simply look at the completed construction. They do not test the operational condition of fixtures and appliances. Faucets are not turned on; drains are not tested for leaks; appliances are not operated; smoke and carbon monoxide detectors are not tested; and so on.

4. Gas and electrical services to a home are not turned on until the final inspection is completed and the home is signed off. The building inspector can approve the appearance of the wiring and gas piping, but nothing is tested as part of the final inspection because you cannot test fixtures without gas or electricity.

Home inspectors arrive when utilities have been turned on. They plug testers into outlets to ensure grounding, correct polarity, and ground fault protection. They operate built-in fixtures and appliances such as dishwashers, garbage disposals, lights, ceiling fans, exhaust fans, electric ovens, garage door openers, and more. They also test the gas-burning fixtures such as forced-air furnaces, water heaters, gas-log fireplaces, and cooking appliances.

5. Building inspectors perform a walk-through inspection only. They do not crawl through subareas or attics, and they do not walk on roofs. Home inspectors do all of these things, enabling them to identify construction defects that routinely go unnoticed during a municipal inspection.

Veteran home inspectors know that all brand-new homes have defects of various kinds, usually minor but sometimes major. Examples include broken roof tiles; missing roof flashing; attics without insulation; furnaces improperly installed in attics; congested drainpipes; drains that leak; nontempered glass next to bathtubs and showers; inoperative GFCI outlets; ungrounded outlets; drain vents that terminate in attics; chimneys in contact with combustible materials in attics; loose safety rails; disconnected air ducts under the house; PVC discharge pipes on water heater relief valves; and this list could go on and on.

These are the reasons why people who buy brand-new homes should hire an independent home inspector. A home inspection gives homebuyers the best opportunity to take advantage of the builder's warranty. Bypassing an inspection leaves undisclosed defects to be discovered at a later date, after the builder's warranty has expired.

    Giants nail down 2-0 Series lead

    Game 2 starter finds postseason form as Giants use small-ball to top Tigers

    SAN FRANCISCO - Long ball one night, a Giant dose of small ball the next.

    Two wins in two games and suddenly San Francisco doesn't need to dig itself out of a postseason hole for a change.

    Madison Bumgarner shut down the Detroit Tigers for seven innings, then the Giants took advantage of a bunt that stayed fair to eke out the go-ahead run in a 2-0 win Thursday night for a 2-0 edge in the World Series.

    Gregor Blanco's single trickled to a stop inches fair on the infield dirt, setting up Brandon Crawford's run-scoring double-play grounder in the seventh. Hunter Pence added a sacrifice fly in the eighth, and that was plenty for these masters of the October comeback.

    "It definitely feels a whole lot better than having our backs against the wall," Bumgarner said. "But you can't relax. We've got to keep pushing."

    Game 3 will be Saturday night in Detroit and for once, the Giants aren't playing from behind. They overcame a 2-0 deficit to beat Cincinnati in the best-of-five division series and escaped a 3-1 hole against St. Louis in the NLCS.

    A day after Pablo Sandoval homered three times, the favored Tigers wondered what other way they could lose. Prince Fielder was thrown out at the plate by a hair and moments later pitcher Doug Fister was struck squarely in the head by Blanco's line drive, a ball hit so hard that it caromed into shallow center field.

    "They asked me the typical concussion questions," Fister said. "I'm not concerned. I have a minor bump. According to my dad, my whole life his saying has always been if I got hit in the head I'd be OK. That's how I take it."

    The 6-foot-8 Fister managed to stay on the mound, and even excelled. Bumgarner more than matched him, however, allowing just two hits before the San Francisco bullpen closed it out before another pulsating crowd.

    Santiago Casilla pitched a perfect eighth and Sergio Romo worked the ninth for a save in the combined two-hitter, leaving Triple Crown winner Miguel Cabrera and his team in a huge hole heading back to Comerica Park. Anibal Sanchez will start for the Tigers against Ryan Vogelsong in Detroit.

    "That's the way baseball is. When things are going well, things are bouncing your way," Giants second baseman Marco Scutaro said. "If things aren't going well, you just keep battling and playing hard. No one is taking anything for granted."

    Even so, several dozen members of the Giants family came onto the field at AT&T Park well after the final out to pose for pictures, wanting to savor what they hope is the Giants' last home game of the year.

    Blanco, meanwhile, was able to celebrate a single that rolled 45 feet, if that.

    "I was joking with (coach) Roberto Kelly when I got to first base, 'We practiced that today,'" Blanco said. "That was a perfect bunt. I wasn't really trying to do that. I think it was just meant to be and I'm thankful that I did it."

    The Tigers looked rusty at the plate, maybe still lost following a five-day layoff after an ALCS sweep of the Yankees. Cabrera hopped up in frustration after Sandoval snared his line drive to third.

    "Well, what are you going to do about it?" Tigers manager Jim Leyland said. "We got two hits tonight. I'm certainly not going to sit up here and rip my offense because last night I thought we had some pretty good swings. Cabrera hit a bullet tonight."

    Bumgarner had something to do with the Tigers' troubles, too.

    Bumped from the NLCS rotation after two poor postseason starts, he returned with a flourish. The left-hander struck out eight and looked as sharp as he did in the 2010 World Series when, as a 21-year-old rookie, he stopped Texas in Game 4 on the way to a championship.

    "Just able to make pitches," Bumgarner said. "I hadn't done a very good job of making pitches this postseason so far and this is a team that you're not going to be able to afford to miss with.

    "They hit some balls hard, but luckily we were in the right spot," he said.

    Along with his bunt, Blanco might have hit the hardest ball of the game ? the liner that nailed Fister in the second inning. The ball struck the right side of his head and deflected on the fly to shallow center field.

    Fister showed no visible effect from the blow ? in fact, some in the crowd wondered whether the ball perhaps glanced off his glove because Fister stayed on his feet. Only when fans saw replays did groans echo around the ballpark.

    Leyland, pitching coach Jeff Jones and a trainer went to the mound, and Fister insisted on staying in the game. He walked the next batter to load the bases with two outs, but retired Bumgarner on a popup, starting a streak of 12 straight hitters set down by Fister.

    "Well, if you'd have been out there, it was something to see," Leyland said. "Because the trainer was saying, 'Where are you?' 'San Francisco.' 'What game is it?' 'Game No. 2.'

    "I don't want to make light of it, but it was kind of comical really because Doug was right on with everything. But I was scared to death when it happened."

    The game remained scoreless until the seventh, right after actor Tom Hanks ? a former peanut vendor at the nearby Oakland Coliseum ? sang "Take Me Out to the Ball Game" on the field.

    Pence led off with a single and Fister departed, getting lots of hugs in the dugout. Rookie reliever Drew Smyly walked Brandon Belt on a full-count pitch and Blanco's bunt loaded the bases with no outs.

    The Tigers kept their infield back up the middle, and had no play at the plate on Crawford's bouncer.

    "We felt like we played double-play depth because we felt like we couldn't give them two runs. That's why we did that, and we got the double play," Leyland said.

    "To be honest with you, we were absolutely thrilled to come out of that inning with one run. Absolutely thrilled. I mean, we had to score anyway."

    Pence added the insurance run the next inning with his flyball off Octavio Dotel.

    "We played good small ball today," Pence said. "We played a great game of baseball, had outstanding pitching and great defense and we found a way to get it done."

    Of the 52 teams to take a 2-0 lead in the World Series, 41 have gone on to win the title. That includes 14 of the last 15 teams with that advantage.

    "I'm not sure, and I haven't done any studies on it," Giants reliever Jeremy Affeldt said, "but statisically it's always better to be 2-0 than 1-1 or 0-2. I'm just guessing."

    Fielder and the Tigers came up inches short of taking an early lead, the result of yet another alert play by Scutaro and a dubious decision by third base coach Gene Lamont.

    Fielder was hit by a pitch to lead off the second, Delmon Young followed with a double and when the ball rattled around in left field, Lamont waved the burly slugger home. Even with no outs, Lamont sent him.

    "I think Gene just got a little overaggressive," Leyland said.

    Scutaro, in the middle of every big play for the Giants this month, dashed across the diamond, caught Blanco's relay and unleashed a strong throw to the plate. All-Star catcher Buster Posey made a swipe tag to Fielder's backside, just as the Tigers star slid home. Umpire Dan Iassogna had a clear look and made a demonstrative call ? out!

    Fielder immediately popped up from his slide and pleaded his case with two hands, saying he didn't feel the tag. Leyland rushed out and pointed to the plate. At second base, Young yelled, "No!"

    But even if there was replay review, it wouldn't have helped the Tigers. Because TV replays showed Iassogna, working his first plate job in a World Series, got it right.

    "Any time those kind of freak plays happen that don't go your way," Fielder said. "It takes away a little momentum but you've got to be aggressive. They made a perfect play."

    There was no dispute that Fister somehow avoided a serious injury moments later.

    Among those who winced was Oakland pitcher Brandon McCarthy, who sustained a skull fracture and brain contusion after being hit by a line drive last month.

    "I'm not watching but did just see the replay. Certainly hope he's ok," McCarthy tweeted.

    Developer Auction Racks Up $78 Million More Bids, Expands To LA

During the first two-week long auction companies made $30 million worth of offers from companies like Quora and Dropbox. Our first story on the company garnered plenty of skepticism in the comments, but the most recent auction hit $78 million worth of bids according to co-founder Matt Mickiewicz. And now the company is expanding beyond New York City, Boston and San Francisco to Los Angeles. Not that DevelopersAuction has been sticking too closely to its original parameters anyway. Ostensibly the company solicits developers who are graduates of Stanford or MIT and/or have worked for companies like Google, Facebook or Apple. But at least one Chicago based developer was accepted even though he didn’t match those criteria. Blaine Schanfeldt tells me he’s a high school and college dropout. His main experience comes from a computer consulting business he started when he was 17 and a cloud computing startup he founded after meeting some fellow entrepreneurs at Startup Weekend. That actually doesn’t sound unlike Mickiewicz’s own background — he started Sitepoint.com, the development and design resource publisher, when he was 14. Schanfeldt says the companies that bid on him definitely knew that they weren’t bidding on an Ivy Leaguer from an A-list web giant. In fact they viewed his resume and many were actually attracted to his entrepreneur spirit — 15 companies to be exact. Mostly in the Bay Area but a couple from New York City and one in Chicago. He also says that the types of companies varied from brand new startups looking to hire employee number one, to more established small companies looking to hire employee number 101. He hasn’t accepted an offer yet — no developer is required to accept the highest bid. Companies are supposed to make good on their promises — assuming they still want to hire a developer after an in-person interview. In other words, neither party is guaranteed anything at the end of the auction. Schanfeldt is planning a trip to the Bay area for a round of interviews. He doesn’t come off as a hot-shot programmer. He says he was really surprised how much attention his resume attracted. “I was really excited when the first offer came in,” he says. If he can?t stop getting in trouble now ? when he has vowed to clean up his act and said publicly he wants to prove he deserves another shot at playing for LSU ? why would any NFL team believe he can stop getting in trouble when he?s a professional?

    There are also questions about whether Mathieu is good enough as a pure cover corner to match up with elite NFL receivers, and about whether a player who likes to deliver big hits but weighs just 175 pounds can hold up over the course of a 16-game NFL season. So Mathieu wouldn?t necessarily be a high first-round pick even if he were a choir boy off the field.

    Mathieu made so many spectacular plays in two seasons at LSU, however, that some NFL team is bound to become enamored with him. If we?re going to compare him to talented but troubled draft prospects from this year, Mathieu is probably closer to Janoris Jenkins, who went in the second round to the Rams, than to Vontaze Burfict, who went undrafted before signing with the Bengals.

    Can Controversial Ocean Iron Fertilization Save Salmon?

    What's been described as a "rogue" geoengineering experiment is really an effort, however flawed, to restore salmon abundance

    In a bid to restore lost fish abundance, the Haida Salmon Restoration Corp. (HSRC) undertook to mimic the effects of a volcanic eruption by fertilizing the ocean with iron. The idea was to provide the missing nutrient for a plankton bloom that would then trickle up the food web and restore salmon?with the ancillary effects of gathering data on the ocean food web and, potentially, removing carbon dioxide from the atmosphere.

    "What if this is a means by which ocean pastures can be stewarded and brought back to health?" asks Russ George, chief scientist of the expedition as well as a controversial businessman with a history of attempting to start CO2-removal schemes ranging from reforestation to ocean fertilization. "This is a tiny village of people trying to take care of their backyard."

    Old Masset village on the Haida Gwaii Islands off the British Columbia coast did this by contracting George and others to initiate the largest such intentional ocean fertilization effort to date. It authorized the release of roughly 110 metric tons of iron dust, 91 metric tons of the iron sulfate fertilizer commonly used as a lawn treatment and employed in other scientific experiments, and nearly 20 metric tons of the iron oxide found in soils around the world. "It's micronutrient enrichment," Jason McNamee, operations officer and corporate director for the HSRC, told a press conference on October 19. "We took a bag of iron, and we slapped it over one square kilometer [of ocean]."

    To do that, this past July the HSRC team motored more than 300 kilometers west from the Haida Gwaii Islands to an ocean eddy in the fishing vessel Ocean Pearl. The area had previously been scouted by collecting water samples since January and lies outside Canadian territorial waters. The team also used more than 20 autonomous oceangoing robots, including two bright yellow gliders and 20 Argo drifter robots on loan from the U.S. National Oceanic and Atmospheric Administration, to survey the scene?work that is ongoing. Over the course of several days the researchers then released the 110 metric tons into the fishing boat's wake in an attempt to raise the levels of iron in the water from one or two parts per trillion up to five to 10, although both concentrations are estimates.

    Satellite images as well as maps of chlorophyll abundance appear to show that the iron did indeed fuel a plankton bloom in August. But questions remain: Was it the right kind of bloom to bury carbon? Will it have any effect on the salmon?

    Ocean restoration
    The HSRC's basic idea is born out of marine biology as well as observations of the aftermath of volcanic eruptions in the region. For example, a lack of iron limits the growth of microscopic plants in the Southern Ocean around Antarctica and elsewhere, a fact that prompted marine biologist John Martin to famously muse: "Give me half a tanker of iron, and I'll give you the next ice age."

    In the summer of 2008 Mount Kasatoshi in Alaska's Aleutian Islands blew, sending volcanic minerals, including iron dust, far to sea and prompting plankton blooms across the Gulf of Alaska. At the same time, years and years of decline in returning salmon populations led researchers to expect few of the fry from 2008 to return in later years, only to find a record salmon run in Canada's Fraser River in 2010.

    N.Y. mom finds 2 kids dead in tub, nanny nearby

    A mother returning to her luxury New York apartment with her 3-year-old found her other two children stabbed to death in a bathtub and the kids' nanny lying unconscious nearby with apparent self-inflicted wounds, New York Police Commissioner Ray Kelly told reporters.

    The mother and daughter were returning from a swimming lesson to the luxury La Rochelle apartment building on the city's affluent Upper West Side at approximately 5:30 p.m., Kelly said. When they found the apartment dark, they asked the doorman if the nanny had left with the other children only to be told that was not the case.

    "She goes looking for her children and finds her 6-year-old daughter and 2-year-old son stabbed to death in the tub," Kelly said.

    The mother's screams could be heard emanating from the apartment, Kelly said.

    A neighbor who lives on the same floor in the building at 57 West 75th Street near Columbus Avenue told The Associated Press that she heard screams around 5:30 p.m.

    "There was some kind of screaming about, 'You slit her throat!' It was horrible," said the neighbor, Rima Starr, a music therapist.

    Starr told AP she believed the nanny had been hired just recently.

    "I met her in the elevator, the day before yesterday, and was making small talk," she said.

    After police arrived, she told AP, the mother remained in the building's lobby, screaming hysterically and clutching her surviving child.

    The nanny, approximately 50 years old, was in critical but stable condition at St. Luke's Hospital, Kelly said.

    She was in police custody, officials said earlier.

    According to Kelly, the preliminary police investigation had not yet yielded a possible motive for the deaths.

    Officials were not yet identifying the victims or the nanny, Kelly said.

    The University of Liverpool has been awarded funding to determine whether differences in our genes determine how patients respond to drugs used to treat Tuberculosis (TB) in Sub-Saharan Africa.

    Professor Andrew Owen, from the University's Department of Molecular and Clinical Pharmacology, is part of an international research team that will explore why some patients respond positively to anti-TB drug treatment while in other patients the treatments fail or the patients experience toxicity. In patients with HIV/AIDS the percentage of patients that are not cured by therapy is even higher.

    TB is the second leading cause of death from an infectious disease worldwide after HIV/AIDS. In 2010 there were 8.8 million new cases of TB and 1.1 million deaths, including 350,000 deaths from TB among people with HIV. In Sub-Saharan Africa TB poses a major public health problem and is the leading killer of people living with HIV, causing one quarter of all deaths.

    Professor Owen said: "There is a much greater understanding of genes which affect how we react and respond to drugs used in other diseases such as HIV than there is for TB. This project will study the genes of patients being treated with the four main anti-TB drugs, and also with a new drug which is in development, using clinical trial sites in Benin, Senegal and South Africa. The study aims to explore and determine genetic differences which affect the effectiveness and reaction to anti-TB drugs. It is funded through the H3Africa project which is led by African scientists and one of its aims is to foster capacity-building for research in Sub Saharan Africa."

    The standard treatment for TB is a six-month course of four drugs taken daily for two months, followed by two drugs taken for a four-month period but as many as 10 per cent of patients do not respond to this treatment. Patients who have been treated with anti-TB drugs have an increased risk of spreading a strain of TB that is resistant to drug treatments.

    TB is caused by bacteria (Mycobacterium tuberculosis) that often affect the lungs. It is spread from person to person through the air. When people with lung TB cough, sneeze or spit, they propel the TB germs into the air and only a few of these germs need to be inhaled for another person to become infected.

    People infected with TB bacteria have a 10% lifetime risk of falling ill with TB. However people with compromised immune systems, such as people living with HIV, malnutrition or diabetes, or those who use tobacco, have a much higher risk of falling ill.

Patients who have been treated with anti-TB drugs have an increased risk of spreading a strain of TB that is resistant to drug treatments.

    TB is caused by bacteria (Mycobacterium tuberculosis) that often affect the lungs. It is spread from person to person through the air. When people with lung TB cough, sneeze or spit, they propel the TB germs into the air and only a few of these germs need to be inhaled for another person to become infected.

    People infected with TB bacteria have a 10% lifetime risk of falling ill with TB. However people with compromised immune systems, such as people living with HIV, malnutrition or diabetes, or those who use tobacco, have a much higher risk of falling ill.

    This project is being led by Dissou Affolabi from the National Hospital for Tuberculosis and Pulmonary Diseases in Benin.     Investing in Iraqi Oil and Gas: Too Risky?

    Risk, like everything else, is relative. So, relatively speaking, Iraq is open for business and certainly a more attractive investment than, say, Libya?in part because it?s easier to see what?s coming in Iraq, while what?s coming in Libya for now is just chaos (and it?s already arrived).

    First, let?s try to paint a picture of the overall security situation, which is also an exercise in relativity.

    In the north, we have the territory controlled by the Kurdish Regional Government (KRG), where business is flourishing (along with corruption) and where one needn?t even engage a controversial Western private security companies to move around.

    But also in the north, we have a belt of disputed territories, which lies between the KRG and the Iraqi central government, both geographically and politically. The clincher is that the KRG?s grand plans for two new pipelines that would bypass the central government and pump oil and gas directly to Turkey are to be undertaken in this disputed territory, specifically in Kirkuk.

    Baghdad won?t stand for it. Already sectarian tensions are being fomented more intensely as Baghdad installs a new military operations center in Kirkuk and Iraqi and Kurdish forces begin a new showdown over security.

    Business is pretty good in central Baghdad, where the security situation is fairly stable (again, relativity is necessary here), but where one doesn?t walk around without physical security. Mathematically speaking, of Baghdad?s 88 zones or neighborhoods, there are about 10 that should be considered highly dangerous. The rest are ?safe?. ?Safe? means that you have a 50-70% chance of coming out alive.

    Then we have everything south of Baghdad, places like Anbar province and the Basra governate. Anbar is where al-Qaeda is regrouping for another round and preparing its forces to join the confrontation in Syria. Basra is Iranian territory?Iraq?s oil-rich golden egg where it is only Iranian influence that is keeping tensions on the low burn.

    Throughout Iraq?s provinces, we have an increasing urge for autonomy, which would essentially render Iraq a failed state. So far, only Kurdistan has autonomy, but others are eyeing it: including DIyala, Anbar, Salahuddin, and Basra.

    In terms of oil, Basra is the most important of these, and much of Basra?s population is angry with Baghdad because the provincial government does not have as much control as it would like over its natural resources and that the revenues aren?t trickling down to the locals.

    ExxonMobil (XOM), for one, appears to have had enough, announcing recently that it may pull up stakes in Iraq?s south and stick to the Kurdish north, where the business arrangements are more flexible and the security situation more manageable, at least outside of Kirkuk.

    So is Iraq too risky an investment? It depends how far ahead you want to look.

    For the next two years, we will probably see more of the political status quo, largely thanks to Iranian intervention, which is the only thing keeping things from falling apart at the seams right now.

    Further down the road, in the absence of a major increase in foreign investment and socio-economic improvement, we are likely to see the start of a failed state, a renewed civil war as more and more provinces jump on the autonomy bandwagon creating tensions among Sunnis and Shi?ites, and a bloody conflict over Kurdish independence.

    Private porn pics aren't private for long

    Eighty-eight?percent of homemade pornography, including videos and still images, finds its way onto porn sites, often without the owners' knowledge, a new study concluded.

    The study analyzed more than 12,000 sexually explicit images uploaded by young people and found that the great majority of images had been stolen and published to what Britain's Internet Watch Foundation (IWF), which published the study, calls "parasite" websites.

    These parasites, exclusively devoted to hosting sexual images featuring young subjects, allegedly obtain their material from anywhere they can get it: lost or stolen cellphones, hacked private accounts on Photobucket, Flickr, or Facebook,? or from chat sites and Tumblr, a blogging platform notorious for the amount of explicit self-published content by high school and college-age students.

    In 2011, the now-defunct IsAnyoneUp.com published tens of thousands of stolen Facebook photos submitted by jaded ex-lovers or angry friends.

    "We need young people to realize that once an image or a video has gone online, they may never be able to remove it entirely," Susie Hargreaves, CEO of the Internet Watch Foundation, told the Guardian newspaper in London. "Once an image has been copied on to a parasite website, it will no longer suffice to simply remove the image from the online account."

    David Wright, director of the UK Safer Internet Center, agreed with the study and reiterated a warning to youngsters not to send sexually explicit messages via their phones, either.?

    "Much of the advice for children and young people is, quite rightly, to not 'sext,'?" he said.

    In its report, the IWF features quotes meant to serve as a warning to others to not even make explicit photos. "One explicit image I took when I was young ...? is coming up on the first page of [unnamed search engine]," one quote read.

    "Every time I begin to feel good and confident about myself? ... I just remember these pictures and what I did," another quote read.

    The people who gave the quotes may be heartened, however, to learn that they're not alone. With camera phones and the ability to posting power in the palm of our hands now, self-made sex photos are easier to make and share than ever before. They can bet they're not alone.

    Today's interviewee is friend and mystery author Edith Maxwell. She's talking about her first mystery in her first series written as?Tace Baker. It's called?Speaking of Murder.Edith Maxwell is the author of Speaking of Murder (Barking Rain Press, under pseudonym Tace Baker) featuring Quaker linguistics professor Lauren Rousseau. Edith holds a PhD in linguistics and is a member of Amesbury Monthly Meeting of Friends. The book was first runner up in the Linda Howard Award for Excellence contestEdith also writes the Local Foods Mysteries. Please tell us about your current release.Speaking of Murder came out from Barking Rain Press just a month ago. Listening to academic blackmail and small-town intrigues, Quaker Linguistics Professor Lauren Rousseau uses her ear for accents and facility with languages to track down not only her star student's killer but also crimes committed by her department chairwoman. What inspired you to write this book?I wanted to start a series about a smart young professor who uses her linguistic knowledge to solve crimes. She's got her own set of problems ? issues with commitment, for example???but starts to overcomes them as she searches for a killer. I thought also making her a Quaker would add depth and an unusual aspect to her character. And then I followed her around and wrote down what happened.What exciting story are you working on next? I'm writing the second book in the Local Foods Mystery series. It opens during a fall Farm-to-Table dinner, and I was lucky enough to attend one at a local farm just last week. Great food in a beautiful setting all in the name of research.When did you first consider yourself a writer? In about third grade. My mother told me I was a good writer and I guess it just stuck. I've written ever since in all kinds of formats - journalism, academic papers, technical documentation ? but fiction is what I love to write.Do you write full-time? If so, what's your work day like?? If not, what do you do other than write and how do you find time to write? Alas, I write technical documentation full time, so fiction gets fit in on weekends, retreats, plane rides, and so on. When I do have a full day available, I get up early and write until about lunchtime, when I usually run out of steam. Staying off the Internet is important on those days. It's hard to find enough time to write the books as well as network and promote, but so far I've managed. I hope to be able to leave the day job sometime in the next few years, though.What would you say is your interesting writing quirk? If you had a camera on me at my desk, you would see me doing all kinds of crazy physical things: figuring out logistics of being grabbed or of holding a weapon while also hanging on to something else; scaring myself so I can describe how the throat thickens and the heart thumps; making weird facial expressions, and more. I have to be careful when I'm out writing in a coffee shop or library!? As a child, what did you want to be when you grew up? I really don't remember. Isn't that strange? I know I aspired to be a teenager. I adored a girl who lived down the street, with her full-skirt dresses and cool shoes. I guess I never thought beyond that.Anything additional you want to share with the readers? Having my first book out is a dream come true, and it never would have happened without the help, support, and education I get from my fellow Sisters in Crime, both in person locally and online.
